Government Claims OVERVIEW A governmental entity may be held liable for injuries caused by it or its employees in the ordinary course of their employment. A lawsuit againt a governmental entity is pursued essentially the same as against a private person or entity, with some important exceptions. WHAT IS A GOVERNMENTAL ENTITY? A governmental entity can exist at the federal, state, county, or local level. Examples of federal governmental entities are the United States federal government, the United States Post Office, and United States Food and Drug Administration. State entities in California include, for example, the State of California and all of its divisions, including the California Highway Patrol, the California State University system, and the California Highway Patrol. County and local governmental entities can be varied and include, all chartered cities, school districts, and city transportation systems. It is vitally important to ascertain as soon as possible after an accident which governmental entity may be responsible. WHAT STEPS DO I HAVE TO TAKE TO RECOVER FOR MY INJURIES? If your injuries might have been even partially caused by a government entity or employee, you must serve a formal claim within a short time after your accident. This period of time usually ranges between 30 days and one year, depending on which type of entity is involved.
